Personal Designations

In accordance with the German language, personal designations refer equally to both genders. The contents of this document are protected by copyright, and any use is excluded. This is regularly checked by appropriate programs.

2. Protection of Personal Data of Natural Persons

In accordance with Art. 13 GDPR, Walser GmbH informs about data processing and its legal basis. These are fundamentally the contractual relationship and consent.

Only such personal data is collected that is necessary for the execution and processing of the contract or that you have voluntarily provided.

Walser GmbH processes your personal data in accordance with the GDPR, based on laws, the contract, or your consent.


3. Type of Data Processed

We process your personal data that you provide to us as part of the contractual relationship or due to a pre-contractual relationship (e.g., booking inquiry), such as name, address, email address, telephone number, date of birth. Additionally, we store the data of your contact with us, such as booking history, your inquiries, contracts, services used at the hotel, etc.

In case of using special services or offers (hotel Wi-Fi), additional data will be processed. This will be indicated in the relevant sections.


4. Purpose and Legal Basis of Processing

If you contact us via our website, make a booking, order a newsletter, or use other services of our hotel, the data provided in the form will be stored by us. If an inquiry or booking process is aborted, the data will not be saved.

We process your personal data for the purpose of fulfilling our pre-contractual obligations, such as responding to your inquiries, fulfilling the contract and associated ancillary services, such as accounting, provision of services, etc., and fulfilling our legal obligations.

The legal basis for data processing is therefore the contract or the pre-contractual relationship as well as Austrian law, insofar as it results in statutory retention obligations. If the processing is not required for contractual purposes, it is based on your consent.


5. Newsletters, Promotional Mailings, Competitions

Provided we have your corresponding consent, we also process your data for promotional and informational purposes, such as sending you newsletters or offers, or for participation in competitions.

You can revoke your consent at any time by email to hotel@eldorado-ischgl.at. We will then promptly delete your email address from our newsletter system.


6. Use of Hotel Wi-Fi

When using the Wi-Fi network, data from this Internet connection (traffic data), such as the IP address, MAC address, access time, and connection duration, are stored. Content data is not stored. The data is stored and deleted in accordance with the provisions of the Telecommunications Act (TKG).


7. Data Retention

Your data will only be stored as long as required by the aforementioned purpose or as long as it is necessary due to statutory retention obligations or justified to protect legitimate interests, such as the defense against compensation claims.

In addition, data will only be stored based on your consent until revoked. Despite your consent, we are not obligated to store the data permanently and may delete it at any time.

Traffic data from Wi-Fi connections is stored or deleted in accordance with the provisions of the Telecommunications Act (TKG).


8. Data Transmission

Data will only be transmitted to third parties, particularly external service providers such as IT service providers, tax consultants, or accountants, if this is necessary for the fulfillment of the contract or for the implementation of pre-contractual measures. To protect our legitimate interests, the data may also be forwarded to lawyers or authorities.

It is noted that under the conditions of § 99 (5) TKG, we are entitled and obligated to transmit traffic data from Wi-Fi connections to courts, public prosecutors, and authorities.

Processor contracts according to Art. 28 GDPR are concluded with service providers.

Data transmission and storage take place via servers of our IT service provider and payment service provider located in the EU / EEA. Data is not transmitted to third countries.


9. Data Security

We take appropriate precautions and technical and organizational measures according to the state of the art to protect your personal data.

Despite our efforts, it cannot be ruled out that information you transmit to us via the Internet or other telecommunications networks may be viewed and used by other persons. We do not accept liability for such unauthorized uses of your data by third parties.


10. Your Rights

As a data subject, you have the right at any time to access information about your stored personal data, its origin and recipients, and the purpose of data processing, as well as the right to rectification, data portability, objection, restriction of processing, blocking, or deletion of incorrect or unlawfully processed data. You also have the right at any time to revoke any consent given for the use of your personal data.

Your request can be fulfilled as long as neither laws, agreements, nor legitimate interests of the controller prevent it.

If there are changes to your personal data, we ask that you notify us accordingly.

Your request for information, deletion, rectification, objection, and/or data transfer, in the latter case, provided it does not cause disproportionate effort, can be addressed to the above-mentioned contact details of the controller.

If you believe that the processing of your personal data by us violates applicable data protection law or that your data protection rights have been violated in another way, please inform us so that we can address this. You also have the option to lodge a complaint with the competent supervisory authority. In Austria, this is the Data Protection Authority.


11. Additional Privacy Policy Website + Cookie Pop-Up

11.1. Server Log Files

Access data: The website operator or page provider collects data about accesses to the site and stores these as "server log files." The following data is logged:

  • Visited website
  • Time at the time of access
  • Amount of data sent in bytes
  • Source/reference from which you came to the page
  • Browser used
  • Operating system used
  • IP address used (if necessary: in anonymized form)

The collected data is only used for statistical evaluations and to improve the website. However, the website operator reserves the right to check the server log files later if there are concrete indications of illegal use.

11.4. Use of Facebook Pixel and Conversion Tracking

With your consent, we use the "visitor action pixel" from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"), within our online presence.

With the help of the Facebook pixel, we can track the actions of users after they have seen or clicked on a Facebook advertisement. The aim is to measure the effectiveness of Facebook advertisements for statistical and market research purposes. The collected data is anonymous for us, meaning we do not see the personal data of individual users. However, this data is stored and processed by Facebook and linked to your Facebook account. The social media platform uses this data for its own advertising purposes, in accordance with Facebook's data usage policy.


11.5. Facebook Plugins

Plugins from the social network facebook.com, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"), are used on these websites.

When you visit a page of our website that contains such a plugin, your browser establishes a direct connection to Facebook's servers. The plugin content is transmitted directly to your browser and integrated into the website. This informs Facebook that you have visited our website. If you are logged into your Facebook account, Facebook can associate your visit to your Facebook account. If you interact with the plugins (e.g., clicking the "Like" button, leaving a comment), this information is also transmitted to and stored on Facebook's servers. You can prevent this association by logging out of your Facebook account.

11.7. YouTube Plugins

Our website uses plugins from the YouTube site operated by Google. The operator of the pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our pages featuring a YouTube plugin, a connection is established to YouTube's servers. The YouTube server is informed about which of our pages you visited.

If you are logged into your YouTube account, you allow YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.
